These Terms and Conditions (“Terms”) govern the provision of casting services by BANTU CASTING LTD,(Hereinafter referred to as "the Agency or BANTU CASTING LTD) to clients (brands, production companies, photographers, directors, talents, models, actors, performers, and contributors). By engaging with the Agency, clients, talents, modelling agencies and all individuals engaging with BANTU CASTING LTD agree to abide by these Terms, which are designed to clarify the roles, responsibilities, and limitations of each party involved.

SCOPE of SERVICE

The Agency offers casting services and fashion consultancy only

This includes talent scouting, shortlisting, and presenting candidates based on the Client’s brief, along with all elements required to perform this duty.

The Agency does not:

  • Provide legal, visa, or employment services,

  • Cover any expenses on behalf of the Client (unless otherwise agreed).

   

  CLIENT’S OBLIGATIONS        

Clients and Modelling Agencies of any type engaging with BANTU CASTING LTD for any casting services or fashion projects must:

  • Provide a detailed casting brief, including the type of Talent required, usage details, location, dates, fees, and project references;

  • Clearly communicate any changes to the brief in a timely manner;

  • Handle all payments and legal agreements with BANTU CASTING LTD selected Talents once casting is complete

  • The Client acknowledges that the Agency's responsibility ends upon delivery of the agreed casting brief (e.g., shortlist, options, casting day coordination, runway show, campaign, editorials, etc.).

             

 MODELING AGENCIES / ALL INDIVIDUALS

 Modeling Agencies and all the individuals involved in fashion activities and coordinated by the Agency:

  • Participate voluntarily and without guarantee of selection or booking;

  • Must be truthful about availability, location, experience, and legal work status of the model

  • Are responsible for negotiating directly with “BANTU CASTING LTD” or their representatives

                     

CASTING FEES AND PAYMENTS

The Casting Fee will be agreed upon in advance and invoiced to the Client before any booking. All charges will be issued in GBP Sterling. It is the Client's responsibility to verify the amount in their own national currency and ensure accuracy of exchange rates.

Rates may vary depending on the nature, scale, and urgency of the project.

The Agency fee may include:

  • A flat or hourly rate per project,

  • A fee based on project complexity or the volume of Talent sourced.

  • A 15 per cent Urgency Fee will be applied if the Client submits a casting brief with a required delivery or shoot date within less than 10 calendar days from receipt of the brief.

  • The Agency reserves the right to apply a 20 per cent VAT (standard UK rate) on top of the Casting Fee.

  • The Casting Fee covers only casting work (pre-selection, coordination, submissions, release, and confirmation). It does not include travel fees, accommodation, or taxes unless otherwise agreed in writing.

  • The Agency applies a 12.5 per cent Service Charge for accounting duties such as tax calculation and Modeling Agency invoicing, on top of the final Casting Fee.

  • Payment Terms: Invoices must be paid within 14 days of receipt. Any exceptions must be agreed in writing by the Agency Director or their authorized representative.

·   Late payments will incur a 10% surplus per day for each day delayed on top of the casting fee. 

 

EXTRA SERVICES

The following are considered Extra Services, with fees to be discussed and agreed upon in writing:

  • Post-Casting Admin Support (cast sheets, call lists, invoices, travel coordination). A 10 per cent Service Charge applies for accounting duties such as tax calculation and modeling agency fees.

  • Casting Special Talents (pets, niche communities, or individuals with unique skills requiring additional research and outreach).An additional Scouting fee may be charged if profiles fall outside of the agency’s database.

       

    CANCELLATION POLICY & REVISION

If a casting project is cancelled by the Client after work has begun, a 25% cancellation fee of the total Casting Fee may apply.

If the brief changes significantly after work has begun (e.g., talent type, location, or timeline), the Agency may:

  • Adjust the fee,

  • Extend the delivery timeline,

  • Or decline the brief if it no longer aligns with the agreed scope

CONFIDENTIALITY AND DATA HANDLING

  • All project briefs, digital materials and talent information shared by the client and by BANTU CASTING LTD to Modeling Agencies and all individuals involved in the projects concerning the agency, will be handled with strict confidentiality and it’s non-sharable to any individual.

  • Talent images, videos, CVs, and personal data will be securely stored and used exclusively for the agreed project unless otherwise permitted in writing by the Agency.

    The Agency complies with all applicable data protection laws, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018 for operations within the United Kingdom, and the EU General Data Protection Regulation (Regulation EU 2016/679) for operations within the European Union, and other relevant data protection laws in jurisdictions where the Agency operates or processes personal data.                                                            

    PORTFOLIO & PROMOTIONS

  • With the Client’s written or verbal consent, the Agency may share behind-the-scenes content, (screenshots, final outcomes, photos, videos and any related material) from completed projects for promotional use on its website or social platforms. Talent names and likenesses will not be published prior permission from all parties involved

    LIMITATION OF LIABILITY

The Agency is not responsible for:

  • The behaviour, punctuality, or performance of any selected Talent;

  • Any dispute, damage, or loss arising from a Client’s direct engagement with the Talent post-casting;

  • Ensuring Talent holds valid documentation, visas or insurances — this remains the Modeling Agencies’ responsibility.

  • The Agency makes best efforts to match appropriate Talent but provides no warranty regarding the final result of the Client’s project.                           

              TERMINATION

  • Either party may terminate a casting engagement in writing prior to completion.

  • All work completed up to the point of termination must be paid for in full.                                                                              

           

                                                               

These Terms shall be governed by the laws of the United Kingdom (UK). Any disputes shall be subject to the exclusive jurisdiction of the courts of that location.
