These Terms and Conditions (“Terms”) govern the provision of casting services by BANTU CASTING LTD, hereinafter referred to as "the Agency or BANTU CASTING LTD to clients,brands, production companies, photographers, directors, etc.) and talents, models, actors, performers, contributors). By engaging with the Agency, Clients, Talents and Modeling Agencies agree to abide by these Terms, which are designed to clarify the roles, responsibilities, and limitations of each party involved.

SCOPE of SERVICE


The Agency offers Casting services and Fashion consultancy only. 

This includes talent scouting, shortlisting, and presenting candidates based on the Client’s brief and all the elements included to perform the duty.

The Agency does not:

  • Represent or manage Talents long-term

  • Provide legal, visa, or employment services,

  • Cover any expenses on behalf of the client (if not agreed and discussed in advance)

                                                           

                                                             

 CLIENT RESPONSIBILITIES

Clients and Modeling Agencies of any type engaging with BANTU CASTING LTD for any casting services or fashion projects must:

  • Provide a detailed casting brief, including the type of Talent required, usage details, location, dates, fees, and project references;

  • Clearly communicate any changes to the brief in a timely manner;

  • Handle all payments, and legal agreements with BANTU CASTING LTD selected Talent or their representatives once casting is complete;

  • Inform the Agency of the final casting decisions in writing,

  • The Client acknowledges that the Agency's responsibility ends upon delivery of the agreed casting brief (e.g., shortlist, options, casting day coordination, runway show, campaign, editorials, ecc..)

             


 MODELING AGENCIES/ FREELANCE TALENTS PARTICIPATION

Modeling Agencies and Freelance Talents involved in casting activities and coordinated by the Agency:

  • Participate voluntarily and without guarantee of selection or booking;

  • Must be truthful about availability, location, experience, and legal work status of the model

  • Are responsible for negotiating directly with “BANTU CASTING LTD” or their representatives if selected

                    

CASTING FEES AND PAYMENTS

A Casting Fee will be agreed upon in advance and invoiced to the Client before proceeding with any booking. All charges to any client will be issued in GBP Sterling. 

It’s The Client's responsibility to verify the valued amount in their own usual currency and ensure the amount reflects the exchange rate.

The rate may vary, depending on the nature of the project and the availability of the client’s budget.

 This fee may include:

  • A flat or hourly rate per project,

  • A Tiered fee based on the project’s complexity or the volume of the Talent sourced 

  • A 15% Urgency Fee will be applied to the total casting fee if the Client submits a casting brief with a required delivery or shoot date within less than 10 calendar days from the date the brief is received. This Extra Service Charge ensures the Agency can prioritize the project and allocate necessary resources to meet the accelerated timeline.

  • The Agency reserves the right to apply a 20% V.A.T standard rate on top of the final cost of the Casting fee.

  • The Casting Fee covers only the casting work (pre-selection, coordination, submissions, release and confirmation). it does not include, travel fees or taxes if not agreed differently by the client;

  • The agency applies a 10% Service charge to The Client for any Accounting duties such as tax calculation and Modeling agencies invoicing considered as “Extra Service” by The Agency (see below) on top of the final Casting Fee.  

  • Payment Terms: Invoices must be paid within 14 days of receipt. In case agreed differently, the final decision must be delivered only and exclusively via writing and with the approval of the Director or their authorized representatives of The Agency.

  • Late payments may incur a 10% surplus per day for each day delayed on top of the casting fee. 


 EXTRA SERVICES

Here below is a list of what the Agency considers as EXTRA SERVICES. Each service fee will be previously discussed singularly and acknowledged by The Client and The Agency. The list includes:

Post Casting - Admin Support

  • Creating cast sheets and call lists, and final talent documents such as invoices and travels after selection on behalf of the Client;The agency applies a 10% Service charge to The Client for any Accounting duties such as tax calculation and modeling agencies fees

Casting Non-Human Talents

  • Casting pets, niche communities, or people with unique skills. These often require special research and outreach.

   

CANCELLATION POLICY & REVISION

If a casting project is cancelled by the Client after work has commenced, a cancellation fee of 25% of the total Casting Fee may apply.

If the casting brief changes significantly after the process has begun (e.g., different talent type, new location, timeline shift), the Agency may:

  • Adjust the fee,

  • Extend the delivery timeline,

  • Or decline the brief if it no longer aligns with the agreed scope

    

CONFIDENTIALITY AND DATA HANDLING

  • All project briefs, casting materials, and talent information shared by the client and by BANTU CASTING LTD to Modeling Agencies and all individuals involved in the projects concerning the agency, will be handled with strict confidentiality and non-sharable to any individual if not agreed differently via written permission by the Director,

  • Talent images, videos, CVs, and any personal data shared for casting purposes will be stored securely and used only for the intended project unless otherwise agreed and cannot be shared if not agreed differently via written permission by the director,

  • The Agency complies with all applicable data protection laws, including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018 for operations within the United Kingdom, and the EU General Data Protection Regulation (Regulation (EU) 2016/679) for operations within the European Union, and other relevant data protection laws in jurisdictions where the Agency operates or processes personal data.

    PORTFOLIOS & PROMOTIONS

With the Client’s written consent, the Agency may share behind-the-scenes content, screenshots, or final outcomes

(photos, videos and any related material) from completed projects for promotional use on its website or social platforms.

Talent names and likenesses will not be published without permission by all parties involved


    LIMITATION OF LIABILITY

The Agency is not responsible for:

  • The behavior, punctuality, or performance of any selected Talent;

  • Any dispute, damage, or loss arising from a Client’s direct engagement with the Talent post-casting;

  • Ensuring Talent holds valid work documentation or insurance — this is exclusively the Modeling agencies’ responsibility to verify.

  • The Agency makes best efforts to match appropriate Talent but provides no warranty on the final result of the Client’s project.                           

    TERMINATION

  • Either party may terminate a casting engagement in writing prior to completion.

  • All work completed up to the point of termination must be paid for in full if not agreed differently via prior written communication.                       

                                                          

GOVERNOR’S LAW

These Terms shall be governed by the laws of the United Kingdom (UK). Any disputes shall be subject to the exclusive jurisdiction of the courts of that location.
